Rectification under Section 154: How to Fix an Income Tax Intimation

When CPC gets it wrong: which errors qualify as "mistakes apparent from record", the four-year limit, and a step-by-step online rectification request.

Rectification under section 154 corrects an obvious mistake in an income-tax order or intimation, including a Sec. 143(1) Income-tax Act intimation. It can resolve missing tax credit, arithmetic errors or an overlooked claim already supported by the record. For FY 2025-26 / AY 2026-27, the Income-tax Act, 1961 provisions discussed below apply. Rectification is not a substitute for revising an incorrect return or appealing a disputed legal conclusion.

What mistakes qualify for rectification under section 154?

A mistake qualifies when it is apparent from the existing record and can be corrected without resolving a debatable legal or factual issue.

Under Sec. 154 Income-tax Act, common examples include:

  • Missing TDS credit: Credit claimed in the return and reflected in Form 26AS was not allowed.
  • Arithmetic errors: Income, tax, surcharge, cess or interest was calculated incorrectly.
  • An overlooked deduction: An eligible deduction was correctly claimed and supported by the return, but processing ignored it.
  • An incorrect capital-gains tax rate: The wrong rate was applied despite the relevant dates, asset classification and other facts being clear.
  • Missed salary-arrears relief: Relief under Sec. 89 Income-tax Act was correctly claimed, with Form 10E filed, but was not considered.

These are not automatic grounds for approval. For example, a capital-gains dispute requiring interpretation of an exemption provision generally belongs in an appeal, not rectification.

Likewise, a deduction missed in your original return ordinarily requires another permissible route. Return-data correction should not be used to introduce a fresh claim needing new facts or investigation.

What is the time limit for filing and deciding rectification?

The ordinary rectification limit is four years from the end of the financial year in which the order sought to be amended was passed.

Under Sec. 154(7) Income-tax Act, an intimation dated October 2026 falls in FY 2026-27, making the ordinary outer limit 31 March 2031. The clock runs from the relevant order, not simply from the assessment year or return-filing date.

Because the provision limits when an amendment may be made, file promptly rather than waiting until the final day.

Under Sec. 154(8) Income-tax Act, the authority must pass an order allowing or refusing your application within six months from the end of the month in which it receives the application. An application received on 12 November 2026 should therefore be decided by 31 May 2027.

Missing this disposal deadline does not automatically mean your application is accepted. Follow up through the portal grievance mechanism or seek professional advice.

Should you choose rectification, a revised return or an appeal?

Choose the remedy according to whether the mistake lies in processing, your return, or the department’s interpretation of facts or law.

An updated return cannot be used to decrease the tax liability determined on an earlier return, claim a refund or increase a refund. Other eligibility restrictions apply.

For AY 2026-27, the outer updated-return date is ordinarily 31 March 2031. Additional income-tax under Sec. 140B Income-tax Act is 25%, 50%, 60% or 70% of the applicable aggregate tax and interest, depending on the filing window.

Importantly, filing rectification does not extend the appeal deadline. Where the issue is arguable, assess appeal protection separately.

How do you submit an online rectification request?

Submit the request through the income-tax e-filing portal using the route appropriate to the order and the nature of the error.

  1. Download the relevant documents. Obtain the filed ITR, acknowledgement, computation, intimation and current Form 26AS.
  2. Identify the exact difference. Compare “as provided by taxpayer” and “as computed” figures in the intimation.
  3. Open Services → Rectification. Select the relevant assessment year and order details.
  4. Choose the available request type. Portal labels and functionality can differ by assessment year and processing authority.
  5. Enter corrections or upload data where required. Use the prescribed online fields or utility-generated file, including JSON where applicable.
  6. Complete submission and any required verification. Save the acknowledgement and reference number.
  7. Track the request. Check rectification status and download the resulting order under Sec. 154 Income-tax Act.

A reprocessing request is suitable where the filed data is correct and needs processing again. Tax-credit mismatch correction addresses permitted corrections to TDS, TCS or tax-payment details. Return-data correction, where available, addresses eligible schedule errors, not unrestricted revision of income or deductions.

If rectification rights rest with the Assessing Officer rather than CPC, use the applicable Assessing Officer route.

What should you check before filing a tax-credit rectification?

Reconcile the credit, its assessment year and the underlying income before asking the department to allow it.

Check the deductor’s TAN, your PAN, the TDS amount and the year to which the credit belongs. For advance tax or self-assessment tax, verify the challan details and assessment year.

Where TDS is missing from Form 26AS, first ask the employer, bank or other deductor to file or correct its TDS statement. Rectification may otherwise reproduce the mismatch. Keep Form 16 or Form 16A and evidence of follow-up.

For deductions, verify eligibility under the tax regime applicable to your return. A deduction restricted under the new regime is not necessarily a processing error.

Retain a short reconciliation explaining each disputed amount alongside your original computation.

How does rectification work in a rupee example?

Rectification can remove both an incorrect principal demand and the related interest where their reversal follows from the corrected record.

Neha’s FY 2025-26 return shows tax payable of ₹80,000, fully covered by employer TDS of ₹80,000. Her second employer files its TDS statement late.

After the missing ₹20,000 appears in Form 26AS, Neha submits the appropriate tax-credit rectification request. Assuming no other default, the corrected order eliminates the ₹21,600 demand.

There is no automatic refund merely because the demand disappears. If Neha already paid it, the resulting excess payment may be refundable, with interest under Sec. 244A Income-tax Act where applicable.

Does filing rectification stop recovery or refund adjustment?

A rectification request alone does not stay recovery or prevent adjustment of future refunds.

Respond separately to the portal’s outstanding-demand entry, selecting the appropriate disagreement option and explaining the error with the rectification reference.

This records your position but does not itself cancel the demand. Review and respond to any proposed refund adjustment under Sec. 245 Income-tax Act.

Where necessary, separately seek recovery protection from the jurisdictional authority. Sec. 220(6) Income-tax Act provides a relevant discretionary mechanism where an appeal is pending.

Can I file rectification more than once?

Yes, for genuine remaining or separate apparent mistakes. Repeating an identical rejected request is unlikely to help and does not restart limitation.

Is there a government filing fee?

No government fee applies to filing a rectification request. Professional assistance, if used, is separate.

What if my request is rejected?

Consider an appeal against an appealable refusal under Sec. 246A Income-tax Act. The usual deadline is 30 days from service of the order, subject to applicable rules.

Can rectification increase my tax liability?

Yes. Under Sec. 154(3) Income-tax Act, an amendment enhancing assessment, reducing a refund or otherwise increasing liability requires notice and a reasonable opportunity to be heard.
