Bengaluru filings go to the Chennai branch of the Trade Marks Registry, but the entire process is online — you never need to leave your desk. The real risk isn't the paperwork; it's an objection or opposition six months in, because someone else has a similar mark in the same class. We run a comprehensive search across the IP India database and common-law usage before we file, so the mark you're building brand equity around is one you can actually own. And because we're IP-registered attorneys, we represent you through examination reports and, if it happens, opposition hearings — without you having to hire separate counsel later.
The process
How we handle trademark registration in bangalore
- 1
45-class trademark search
We search the IP India database, common-law usage, and MCA company names across every class you might need. Delivered as a written opinion with green/amber/red risk rating.
- 2
Class selection and specification drafting
The description of goods/services determines the strength of your protection. We draft it broad enough to defend, narrow enough to survive examination.
- 3
Application filing (TM-A)
Filed online via IP India portal, application number issued within minutes. You can start using 'TM' beside your mark immediately.
- 4
Examination and reply
Registrar issues an examination report within 2–4 months. Most cite Section 9 (descriptiveness) or Section 11 (similar prior mark) — we draft the reply and, where required, attend the hearing.
- 5
Publication and registration
Post-examination, the mark is published in the Trade Marks Journal for a 4-month opposition window. If unopposed, the registration certificate issues and you can use ®.
Documents required
What you'll need to share
- Logo file (JPG/PNG, 8cm x 8cm max) — or word mark if text only
- DPIIT Startup / MSME Udyam certificate (for reduced fees)
- PAN of applicant (individual or entity)
- Address proof of applicant
- Signed Form TM-48 (Power of Attorney) — we draft this
- Description of goods/services the mark will cover
- Date of first use in commerce (if already in use)
Karnataka-specific notes
What matters if you're operating from Bengaluru
- The Chennai branch of the Trade Marks Registry serves all Karnataka applicants. Physical hearings, when required, are at Chennai — but 90% of hearings now happen via video conference.
- Bengaluru's SaaS and services concentration means most local applicants file in Class 35 (advertising/business services), Class 41 (education), or Class 42 (SaaS/technology). Product startups typically need Class 9 (electronics/software) as well.
- DPIIT Startup India recognition (issued by GoI) or Karnataka Udyam MSME registration both qualify you for the ₹4,500/class fee. Karnataka has one of the fastest Udyam processing rates in India.
- Karnataka does not have a state-specific trademark database — India runs one central Trade Marks Registry. But local Kannada-language marks or geographical indications (GI) tied to Karnataka (Mysore silk, Nanjangud banana) have separate GI protection under the GI Act.
- If your Bengaluru company will export or fundraise abroad, we recommend filing Madrid Protocol applications for target countries within 6 months of the Indian filing — the Indian priority date carries over.
