A partition deed in Karnataka records how joint owners divide immovable property into defined, separately owned shares. Which route should a family use to divide property?
The appropriate route depends on whether the owners agree and whether the document itself divides the property or merely records an earlier settlement.

Calling a document a “memorandum” does not avoid registration. Courts examine its wording, timing and actual operation.
A partition suit can take years. A final partition decree may require appropriate stamping before implementation; its registration treatment differs from that of a privately executed deed.
How is partition different from relinquishment or gift?
Partition separates existing ownership rights, while relinquishment and gift transfer rights from one person to another.
In a straightforward partition, each co-owner receives a defined portion. A relinquishment involves one co-owner surrendering their interest in favour of another co-owner. A gift transfers property without consideration and can benefit someone who was not previously a co-owner.

Where one sibling receives only money and exits ownership, examine whether the arrangement is genuinely a partition with equalisation payments or, in substance, a release or sale. The document’s heading alone does not decide stamp duty or tax treatment.
How are Karnataka partition stamp duty and registration fees calculated?
Partition instruments are assessed under Article 39 Karnataka Stamp Act, 1957, with different treatment for qualifying family partitions and other partitions.
For the non-concessional category, the statutory framework looks at the separated share or shares, excluding the largest remaining share. Qualifying family partitions receive the treatment specified in the applicable Article 39 schedule. Do not assume that every relative qualifies under its definition of family.
Before execution, establish:
- Whether the parties satisfy the statutory family definition.
- The property’s classification, location and relevant value.
- The number and nature of shares being separated.
- Whether cash payments or additional transfers affect classification.
Registration fees are additional to stamp duty. Verify the current schedule and assessment through Kaveri 2.0 and the jurisdictional sub-registrar. Older online charts may miss amendments or apply the wrong property category.
Under-stamping can lead to impounding, deficit duty and penalties.
What documents should owners collect before drafting?
Owners should collect a complete title chain, inheritance evidence, current property records and a workable division plan.
The usual checklist includes:
- Title documents: Sale deeds, earlier partition deeds, wills and documents explaining how ownership passed.
- Inheritance evidence: Death certificates, family-tree or legal-heir records, and probate or other court documents where applicable. A succession certificate generally concerns debts and securities, not title to land. See legal heir vs succession certificate.
- Encumbrance certificate: Commonly covering 13–30 years, with the search extended where the title history requires. An EC alone does not establish clear title.
- Municipal records: Latest khata or equivalent entry and property-tax receipts.
- Survey and building records: Sketches, boundaries and sanctioned plans; RTC/pahani, mutation and survey records for agricultural land.
- Execution documents: Identity and address proofs, photographs and identification for two witnesses, as required by the registration process.
Check mortgages, litigation, missing heirs and minors’ interests before agreeing to the division.
What are the steps for registering and implementing the partition?
The process involves agreeing on enforceable shares, executing and registering the correct instrument, and updating the relevant property records.
- Settle the allocation. Identify portions, access, common facilities and cash equalisation payments, sometimes called “owelty”.
- Check feasibility. A private agreement cannot override building rules, subdivision restrictions or agricultural land requirements.
- Draft precise schedules. State boundaries, measurements, undivided land shares, staircase access, terraces, parking and maintenance obligations.
- Complete stamping and booking. Pay through the authorised process and arrange registration through Kaveri 2.0.
- Execute and admit execution. Ordinarily, all executing owners attend with witnesses for identity and biometric checks. A legally valid representative may act where permitted.
Sec. 23 Registration Act, 1908 generally requires presentation within four months of execution.
After registration, apply for khata bifurcation or transfer with the competent Bengaluru city corporation, development authority or panchayat, as applicable. Agricultural property may require mutation and survey subdivision. Registration does not guarantee these approvals, and mutation does not itself create title.
How does a cash-adjusted partition work in rupees?
Cash adjustments can equalise unequal physical allotments, but the legal and tax classification must be checked separately.
Three siblings inherit a 40 × 60 site in Jayanagar with a two-storey house. Assume its agreed value is ₹1,35,00,000 and each sibling owns one-third, worth ₹45,00,000.
For illustration, the ground-floor and first-floor allotments, each including specified land and common-area rights, are valued equally.

A and B therefore each need ₹22,50,000 in settlement funds, plus their agreed allocation of statutory charges and professional expenses.
The deed must address land ownership, common access and C’s discharge of rights. Do not assume that floor-wise khatas are available or that C’s ₹45 lakh receipt is automatically tax-free.
What income-tax issues arise for FY 2025-26?
A genuine partition may avoid capital-gains treatment, but HUF partitions, ordinary co-ownership divisions and cash buyouts require separate analysis.
The Income-tax Act, 1961 applies for FY 2025-26 / AY 2026-27.
Sec. 47(i) Income-tax Act excludes distribution of capital assets on the total or partial partition of a Hindu undivided family from “transfer”. However, Sec. 171 Income-tax Act separately governs assessment and recognition of HUF partitions.
Under Sec. 171(9) Income-tax Act, partial partitions occurring after 31 December 1978 are not recognised for its assessment purposes. A registered document alone does not secure income-tax recognition of an HUF partition.
For ordinary co-owners, a genuine division reflecting pre-existing rights is generally not treated as a transfer. However, Sec. 47(i) is specifically an HUF provision, not a blanket exemption for every family arrangement.
Cash paid for surrendering ownership may create capital-gains exposure depending on the substance. Review acquisition cost, holding period and valuation; where a taxable land or building transfer arises, examine Sec. 50C Income-tax Act and any applicable withholding obligations.

Frequently asked questions
Is an unregistered partition deed valid?
If registration is compulsory, it cannot establish the intended property division. Sec. 49 Registration Act, 1908 restricts its evidentiary use, subject to limited exceptions, including qualifying collateral purposes.
Can a daughter claim an equal share?
Yes, in Mitakshara coparcenary property under Sec. 6 Hindu Succession Act, 1956, as amended in 2005 and affirmed in Vineeta Sharma (2020). Protected earlier dispositions and partitions require review.
How long does an agreed partition take?
With clean documents and available appointments, drafting and registration commonly take 2–4 weeks. Title disputes, surveys and khata changes can take longer.
Does registration automatically produce separate khatas?
No. Separate applications and compliance with the relevant municipal or revenue requirements are necessary.
Is a cash equalisation payment always taxable?
No. Its treatment depends on existing rights and the arrangement’s substance. Describing a payment as “owelty” does not, by itself, establish exemption.
